State Environmental Planning Policies (SEPP)
SEPPs are
prepared by the Government and can override regional environmental plans
(REPs) and Local Environmental Plans (LEPs). There are numerous SEPPs
which include:
SEP 1, which allows a variation of development standards such as restrictions as to the
height of a building.
SEP 33, which regulates hazardous and offensive development.
LEPs divide land into different zones and provide for the type of development
which is allowed in each respective zone. It is possible for Council
to rezone portions of land to allow certain developments to proceed.
Appeals against Council decisions are taken to the Land and Environment
Court.
